The most important deadline comes earlier. A signed sale contract should be deposited at the district Land Registry within six months of signing. This records the buyer’s claim against the property, helps protect money already paid and may allow a court to order the transfer if the seller later refuses to complete it.

Does a foreign buyer need permission to purchase property in Cyprus?
Cap. 109’s definition of “alien” excludes nationals of the EU and European Economic Area, along with qualifying buyers of Cypriot descent and non-separated spouses of Cypriot citizens.
Other foreign buyers, including Americans, require the Council of Ministers’ permission to acquire immovable property. In practice, the application is made through the local District Administration using form COMM 145.
The Ministry of Interior’s own service page sets out the practical shape. Permission covers either a plot of up to 4,000 m² for building one owner-occupied home, or up to two units: two dwellings, or a dwelling plus a small shop, or a dwelling plus an office. A married couple shares one allowance rather than doubling it.
There is no application fee, and the Ministry’s page gives a current processing estimate of two to three weeks. This is an administrative estimate rather than a statutory guarantee; the law requires the decision to be made “with all possible speed.”
Signing the contract before the permit is normal because the application requires a copy of the signed agreement. Until permission is granted, however, the contract does not confer a right of acquisition on the foreign buyer.
Ownership cannot lawfully be registered before the required permission has been granted. Any registration made in contravention of Cap. 109 is void.
The contract-deposit mechanism below is what protects the buyer’s position while the permit and eventual transfer are pending.
Why must the sale contract be deposited within six months?
Cap. 109 preserves a foreign buyer’s rights under the Sale of Immovable Property (Specific Performance) Law of 2011. This law can allow a court to order the transfer of the property when a seller refuses to complete the sale. The protection applies regardless of nationality and can operate while the foreign-buyer permit is pending.
The signed contract must be deposited at the district Land Registry within six months of signing. From the date of deposit, it becomes a real charge on the property with priority from that date. A contractual term that attempts to prohibit the deposit is void.
Depositing the contract provides several protections under the law:
- It secures every euro you have actually paid toward the price.
- It may allow a court to order the property registered in your name even if the seller refuses to cooperate.
- Where the developer’s bank already holds a mortgage over the land, the buyer may pay the mortgagee the part of the debt attributable to the unit. The mortgagee must accept the payment, after which the deposited contract’s charge can take priority over the older mortgage under the statutory mechanism.
A seller who mortgages property covered by an undeposited contract without first depositing that contract commits a criminal offense punishable by up to two years’ imprisonment, a €5,000 fine (about US$5,800), or both.
Have your lawyer deposit the contract promptly after signing, in parallel with the permit application. Do not wait for the permit before protecting the contractual position.
What search certificate must the seller provide?
For every contract signed on or after December 12, 2023, the seller must attach a Land Registry search certificate dated no more than five working days before signing. The certificate shows the registered owner and any mortgages or other claims recorded against the property.
A seller who omits it can be fined up to €10,000 (about US$11,500) by the Department of Lands and Surveys, and a mortgagee who refuses the formal release mechanism that accompanies it faces fines up to €100,000 (about US$115,300).
For a post-2023 contract, do not sign without the required current search certificate. A missing or stale certificate is a failure to comply with a statutory requirement and should be resolved before the buyer commits.
Is it safe to buy before a separate title deed exists?
Many properties, especially new-build apartments, are sold and occupied before a separate title deed for the unit has been issued. An individual deed can only be created after the developer’s parent parcel has been formally subdivided.
The government’s permit checklist anticipates this situation by requesting planning consent where separate deeds have not yet been issued. Buying before the deed exists is not automatically invalid, but it changes the buyer’s protection. Until title is issued and transferred, the deposited contract and the underlying planning and mortgage checks are especially important.
Cyprus’s “trapped buyers,” who had paid in full but could not receive title because of a developer’s debts, led to protective legislation in 2015. The Court of Appeal struck down core provisions in June 2024, and the legislature enacted a revised mechanism in July 2025 for fully paid buyers awaiting title.
The revised law’s detailed procedure falls outside this guide. Its history shows why the deposited contract, current search certificate, and review of the developer’s mortgage position should be treated as substantive protections rather than administrative paperwork.

How much should a foreign buyer budget for taxes and transfer fees?

Transfer fees run on a progressive scale (3% to €85,000, 5% to €170,000, 8% above, roughly US$98,000 and US$196,100 at today’s rate), permanently halved by a standing 50% reduction, and waived entirely where VAT applies to the purchase. VAT on new builds is 19%, or a reduced 5% for a qualifying main residence under capped conditions. Stamp duty on sale contracts was abolished for documents signed from January 1, 2026.
On an illustrative €300,000 (about US$346,000) purchase, an ordinary resale costs roughly €8,600 (about US$9,900) in transfer tax. A qualifying new build costs €15,000 (about US$17,300) at 5% VAT, while a new build charged at the standard 19% VAT costs €57,000 (about US$65,700). Legal and agent fees are excluded because they vary by provider and transaction.
Recurring ownership costs are their own article: the national immovable property tax died in 2017, but the municipal bills that survived it did not, Cyprus immovable property tax.
The Ministry’s current permit checklist still asks for a contract “with the requisite stamp duty affixed,” despite the 2026 abolition. Ask your lawyer to confirm the treatment that applies to the date of your contract rather than relying on the older wording.
When should you appoint a lawyer and pay a reservation fee?
Cypriot law does not require a buyer to hire a lawyer, but the permit, contract deposit, title, mortgage, planning, and search-certificate checks call for independent representation.
The UK government’s buyer guidance for Cyprus lists lawyers acting for both seller and buyer among common complaints and advises caution where title deeds are not readily available. Appoint an advocate who acts only for you and ask them to control the search-certificate, contract-deposit, and permit deadlines.
Paying a reservation fee while the contract is prepared is common market practice, but it does not have the same statutory protection as a written and deposited sale contract. Keep the amount modest, document the refund conditions, and have your lawyer review the terms before payment.
Cypriot banks follow EU anti-money-laundering rules supervised by the Central Bank of Cyprus. Expect checks showing where the purchase money came from. American buyers will also complete a US tax-reporting declaration under FATCA. Begin the banking process early enough to meet the contractual timetable.
Do the same protections apply in Northern Cyprus?
The protections described in this guide apply to the Republic of Cyprus, not to property in the north.
Property in the north, outside the Republic’s effective control, does not follow the same Republic-of-Cyprus and EU process. It carries a different category of title risk and may expose a buyer to Republic-of-Cyprus judgments enforceable elsewhere in the EU. What about rental returns and residency?

Cyprus also has a permanent-residency-by-investment route linked to property, but its current thresholds and conditions should be confirmed directly with an independent immigration lawyer before they influence a purchase.
What is the safest order for buying in Cyprus?
- Property search and reservation (market practice; your least protected money, keep it small and documented).
- Independent lawyer engaged, before the reservation hardens into commitment.
- Contract of sale signed, with the seller’s five-working-day search certificate attached as the law requires for post-2023 contracts; its absence is a statutory red flag.
- Deposit the contract at the district Land Registry within six months of signing. This creates the charge that protects the buyer’s contractual position.
- Permit application (non-EU buyers): COMM 145 to the District Administration, signed contract enclosed. No fee; two to three weeks in current practice.
- Obtain the permit before registration. Ownership cannot lawfully be registered before it is granted.
- Make payments under the contract and settle the applicable transfer fees or VAT, using the calculations in our Cyprus transfer-fee guide.
- Funds moved through the required bank checks, including US foreign-account paperwork; bank timing planned, not assumed.
- Register the transfer at the Land Registry if the separate deed exists. If it does not, the deposited contract continues to protect the buyer’s position while title is pending, subject to the statutory process.
- After completion, confirm municipal property charges, rental returns and taxes, and any residency plan with the relevant specialist.
The key is to protect the contract promptly rather than waiting for the separate title deed or foreign-buyer permit to arrive.
